ผู้ใดนำเข้าในหรือส่งออกไปนอกราชอาณาจักรซึ่งหนังสือเดินทางปลอมตามมาตรา ๒๖๙/๘ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท ถ้าการกระทำความผิดตามวรรคหนึ่งได้กระทำไปเพื่อจำหน่าย ต้องระวางโทษจำคุกตั้งแต่สามปีถึงยี่สิบปี และปรับตั้งแต่หกหมื่นบาทถึงสี่แสนบาท

Whoever imports into or exports out of the Kingdom a forged passport under Section 269/8 shall be liable to imprisonment from one year to ten years and a fine from twenty thousand baht to two hundred thousand baht.
If the offence under paragraph one is committed for the purpose of sale, the offender shall be liable to imprisonment from three years to twenty years and a fine from sixty thousand baht to four hundred thousand baht.

Section 269/10 is the cross border counterpart of Section 269/9, and its two paragraphs mirror the same distinction between personal use and trade. Paragraph one sets the base range for import or export at one to ten years with a mandatory fine. Paragraph two applies where the act was done for the purpose of sale and adopts the same three to twenty year range as Section 269/9 paragraph two. Two points of construction follow from the drafting. First, the offence is complete on the act of importing or exporting, so it does not require that the passport be used or presented to any officer. Second, the presumption in Section 269/9 paragraph three, that two or more forged passports are held for sale, is expressed as applying to possession under that Section and is not repeated here, so under paragraph two the purpose of sale is a matter for proof rather than presumption, although the number carried will be strong evidence of it.

This is the provision that applies at the airport. A traveller arriving at a Thai border with an irregular passport is exposed under this Section as well as under Section 269/9, and immigration referrals to police are routine. The practical significance of paragraph two is that intent to sell must be proved rather than presumed, so the defence position on a single booklet is materially stronger here than under Section 269/9. Note that the Immigration Act offences are usually charged in parallel, and that a conviction under either results in deportation and a permanent bar on re-entry.
