ผู้ใดใช้ดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราที่ทำปลอมขึ้นตามมาตรา ๒๖๙/๑๒ ต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี และปรับตั้งแต่สองหมื่นบาทถึงสองแสนบาท ถ้าผู้กระทำความผิดตามวรรคหนึ่งเป็นผู้ปลอมซึ่งดวงตรา รอยตรา หรือแผ่นปะตรวจลงตราตามมาตรา ๒๖๙/๑๒ ให้ลงโทษตามมาตรานี้แต่กระทงเดียว

Whoever uses a seal, a seal impression, or a visa sticker forged under Section 269/12 shall be liable to imprisonment from one year to ten years and a fine from twenty thousand baht to two hundred thousand baht.
If the offender under paragraph one is the person who forged the seal, the seal impression, or the visa sticker under Section 269/12, that offender shall be punished under this Section as a single offence only.

Section 269/13 is the use offence of the visa group and carries the same one to ten year range as the forging offence in Section 269/12, with a mandatory fine. Paragraph two is the familiar merger rule: where the user is also the forger, punishment is under this Section as a single offence. The Section is important beyond its own terms because Section 269/15 fixes its own penalty by reference to it, at two thirds. The conduct reached is using, which in practice means affixing the sticker or applying the stamp to a passport, or presenting a passport that bears one. That second form matters: the traveller who presents a passport carrying a forged visa stamp is using it within the meaning of this Section, and liability does not depend on having made or affixed the stamp himself, although knowledge remains an element of the offence as a matter of general principle under Section 59.

This is the Section that catches the traveller rather than the agent, and it is the realistic risk for a foreign resident who bought a visa or an extension through an intermediary. The defence in that situation is the absence of intention under Section 59: a person who genuinely believed the stamp was issued by Immigration does not commit the offence, but the burden of making that credible falls in practice on the accused, and paying cash to an agent who took the passport away is a poor starting point. Keep the receipt, the agent's identity, and any correspondence. Where the forged stamp was used to remain in Thailand, overstay and Immigration Act charges follow, and a conviction leads to deportation and blacklisting.
