ก่อนที่นายทะเบียนรับจดทะเบียนมูลนิธิ ผู้ขอจัดตั้งมูลนิธิมีสิทธิขอถอนการจัดตั้งมูลนิธิได้โดยทำเป็นหนังสือยื่นต่อนายทะเบียน สิทธิที่จะขอถอนการจัดตั้งมูลนิธินี้ไม่ตกทอดไปยังทายาท ในกรณีที่มีผู้ขอจัดตั้งมูลนิธิหลายคน ถ้าผู้ขอจัดตั้งมูลนิธิคนหนึ่งคนใดใช้สิทธิถอนการจัดตั้งมูลนิธิ ให้คำขอจัดตั้งมูลนิธินั้นเป็นอันระงับไป

Avant l'enregistrement de la fondation par le greffier, le demandeur peut retirer sa demande en adressant une notification écrite au greffier. Ce droit de retrait n'est pas transmissible aux héritiers. Si la demande de création de la fondation est déposée par plusieurs personnes, le retrait de l'une d'entre elles entraîne son extinction.
