Même en présence d'une clause de délai de paiement, si l'acheteur fait faillite avant la livraison, ou était en faillite au moment de la vente à l'insu du vendeur, ou compromet ou réduit la garantie de paiement fournie, le vendeur est en droit de conserver le bien vendu, à moins que l'acheteur ne fournisse une garantie suffisante.
