ถ้าผู้ซื้อผิดนัด ผู้ขายซึ่งได้ยึดหน่วงทรัพย์สินไว้ตามมาตราทั้งหลายที่กล่าวมา อาจจะใช้ทางแก้ต่อไปนี้แทนทางแก้สามัญในการไม่ชำระหนี้ได้ คือมีจดหมายบอกกล่าวไปยังผู้ซื้อให้ใช้ราคากับทั้งค่าจับจ่ายเกี่ยวกับการภายในเวลาอันควรซึ่งต้องกำหนดลงไว้ในคำบอกกล่าวนั้นด้วย ถ้าผู้ซื้อละเลยเสียไม่ทำตามคำบอกกล่าว ผู้ขายอาจนำทรัพย์สินนั้นออกขายทอดตลาดได้

When the buyer is in default, the seller who retains the property under the foregoing sections can, instead of using the ordinary remedies for non- performance, notify the buyer in writing to pay the price and incidental charges, within a reasonable time to be fixed in the notice. If the buyer fails to comply with the notice, the seller can sell the property by public auction.
