เมื่อบุคคลผู้ถูกศาลสั่งให้เป็นคนสาบสูญนั้นเองหรือผู้มีส่วนได้เสียหรือพนักงานอัยการร้องขอต่อศาล และพิสูจน์ได้ว่าบุคคลผู้ถูกศาลสั่งให้เป็นคนสาบสูญนั้นยังคงมีชีวิตอยู่ก็ดี หรือว่าตายในเวลาอื่นผิดไปจากเวลาดังระบุไว้ในมาตรา ๖๒ ก็ดี ให้ศาลสั่งถอนคำสั่งให้เป็นคนสาบสูญนั้น แต่การถอนคำสั่งนี้ย่อมไม่กระทบกระเทือนถึงความสมบูรณ์แห่งการทั้งหลายอันได้ทำไปโดยสุจริตในระหว่างเวลาตั้งแต่ศาลมีคำสั่งให้เป็นคนสาบสูญจนถึงเวลาถอนคำสั่งนั้น บุคคลผู้ได้ทรัพย์สินมาเนื่องแต่การที่ศาลสั่งให้บุคคลใดเป็นคนสาบสูญ แต่ต้องเสียสิทธิของตนไปเพราะศาลสั่งถอนคำสั่งให้บุคคลนั้นเป็นคนสาบสูญ ให้นำบทบัญญัติว่าด้วยลาภมิควรได้แห่งประมวลกฎหมายนี้มาใช้บังคับโดยอนุโลม

When the person who has been adjudged to have disappeared, or an interested person, or the public prosecutor applies to the court and proves that the person adjudged to have disappeared is still living, or that they died at a time other than that specified in Section 62, the court shall revoke the adjudication of disappearance. That revocation does not affect the validity of acts done in good faith during the period between the adjudication of disappearance and its revocation.
Where a person acquired property in consequence of the adjudication that another person had disappeared, and loses that right because the court revokes the adjudication, the provisions of this Code concerning undue enrichment apply mutatis mutandis.
