Article 100: Notice to admit facts or documents

คู่ความฝ่ายใดฝ่ายหนึ่งซึ่งประสงค์จะอ้างอิงข้อเท็จจริงใดและขอให้คู่ความฝ่ายอื่นตอบว่าจะรับรองข้อเท็จจริงนั้นว่าถูกต้องหรือไม่ อาจส่งคำบอกกล่าวเป็นหนังสือแจ้งรายการข้อเท็จจริงนั้นไปให้คู่ความฝ่ายอื่นก่อนวันสืบพยานไม่น้อยกว่าเจ็ดวัน ถ้าคู่ความฝ่ายอื่นได้รับคำบอกกล่าวโดยชอบแล้ว เมื่อคู่ความฝ่ายที่ส่งคำบอกกล่าวร้องขอต่อศาลในวันสืบพยาน ให้ศาลสอบถามคู่ความฝ่ายอื่นว่าจะยอมรับข้อเท็จจริงตามที่ได้รับคำบอกกล่าวนั้นว่าถูกต้องหรือไม่ แล้วให้ศาลจดคำตอบไว้ในรายงานกระบวนพิจารณา ถ้าคู่ความฝ่ายนั้นไม่ตอบคำถามเกี่ยวกับข้อเท็จจริงใด หรือปฏิเสธข้อเท็จจริงใดโดยไม่มีเหตุแห่งการปฏิเสธโดยชัดแจ้ง ให้ถือว่ายอมรับข้อเท็จจริงนั้นแล้ว เว้นแต่ศาลจะเห็นว่าคู่ความฝ่ายนั้นไม่อยู่ในวิสัยที่จะตอบหรือแสดงเหตุแห่งการปฏิเสธโดยชัดแจ้งในขณะนั้น ศาลจะมีคำสั่งให้คู่ความฝ่ายนั้นทำคำแถลงเกี่ยวกับข้อเท็จจริงนั้นมายื่นต่อศาลภายในระยะเวลาที่ศาลเห็นสมควรก็ได้บทบัญญัติแห่งมาตรานี้ให้ใช้บังคับแก่เรื่องเอกสารทั้งหมดหรือฉบับใดฉบับหนึ่งที่คู่ความแสดงความจำนงจะอ้างอิงด้วยโดยอนุโลม แต่ต้องส่งสำเนาเอกสารนั้นไปพร้อมกับคำบอกกล่าวและต้องมีต้นฉบับเอกสารนั้นให้คู่ความฝ่ายอื่นตรวจดูได้เมื่อต้องการ เว้นแต่ต้นฉบับเอกสารนั้นอยู่ในความครอบครองของคู่ความฝ่ายอื่นหรือของบุคคลภายนอก

English translation

A party who wishes to rely on any fact and to ask the other party to answer whether it admits that fact as correct may serve a written notice stating the particulars of that fact on the other party not less than seven days before the date of taking evidence. If the other party has been duly served with the notice, then when the party who served the notice applies to the court on the evidence-taking date, the court shall ask the other party whether it admits the fact stated in the notice as correct, and the court shall record the answer in the report of proceedings. If that party does not answer the question on any fact, or denies any fact without expressly stating the ground of denial, it shall be deemed to have admitted that fact, unless the court is of the opinion that the party is not in a position to answer or to state the ground of denial expressly at that time, in which case the court may order that party to submit a statement concerning that fact to the court within the time the court thinks fit.
The provisions of this section shall apply mutatis mutandis to all or any document that a party expresses an intention to rely on, but a copy of that document must be served together with the notice, and the original document must be available for the other party to examine when required, unless the original is in the possession of the other party or of a third person.

Section 100 provides a mechanism to narrow the issues before trial by inviting formal admissions of fact or of documents. A party serves a written notice at least seven days before the evidence date; if the recipient, duly served, fails to answer at the hearing or denies without expressly stating a ground, the fact is deemed admitted, subject to the court's power to allow a later statement where the party genuinely cannot respond at the time. For documents, a copy must accompany the notice and the original must be available for inspection, except where it lies with the opponent or a third person. The tool reduces unnecessary proof and dovetails with the disclosure duties in Sections 88 and 90.

Why this matters in practice

A notice to admit is a cheap way to cut out uncontested facts and documents, saving witness time and cost, so consider serving one where you expect the other side has no real answer. Just as important, if you receive such a notice, respond in time and give clear grounds for any denial, because silence or a bare denial can be deemed an admission that binds you at trial. Qu'est-ce qu'une notification d'admission de faits ?

En vertu de l'article 100, un avis écrit signifié au moins sept jours avant la date de preuve demandant à l'autre partie d'admettre que les faits énoncés sont corrects, de sorte qu'ils n'ont pas besoin d'être prouvés.

Que se passe-t-il si j'ignore ou si je nie vaguement l'avis ?

Si vous êtes dûment notifié et que vous ne répondez pas, ou que vous niez sans indiquer expressément de motif, le tribunal peut considérer le fait comme admis, à moins qu'il n'accepte que vous ne pouviez pas répondre à ce moment-là.

Cette notification est-elle également valable pour les documents ?

Oui. La même procédure s'applique aux documents, mais vous devez en signifier une copie avec l'avis et conserver l'original à disposition pour consultation, sauf s'il est détenu par la partie adverse ou par un tiers.
