Article 159: Waiver revisited if party can pay

ถ้าปรากฏต่อศาลว่าผู้ที่ได้รับยกเว้นค่าธรรมเนียมศาลนั้นสามารถเสียค่าธรรมเนียมศาลได้ตั้งแต่เวลาที่ยื่นคำร้องตามมาตรา ๑๕๖ หรือในภายหลังก่อนศาลวินิจฉัยชี้ขาดคดี ให้ศาลมีคำสั่งให้บุคคลนั้นชำระค่าธรรมเนียมศาลที่ได้รับยกเว้นต่อศาลภายในระยะเวลาที่ศาลเห็นสมควรกำหนดก็ได้ หากไม่ปฏิบัติตาม ให้ศาลมีคำสั่งยึดหรืออายัดทรัพย์สินของผู้ได้รับยกเว้นค่าธรรมเนียมศาลนั้นทั้งหมดหรือแต่บางส่วนไว้รอคำวินิจฉัยชี้ขาดในเรื่องค่าฤชาธรรมเนียม
ในกรณีตามวรรคหนึ่ง ถ้าศาลเห็นว่า
(๑) ค่าฤชาธรรมเนียมจะเป็นพับแก่คู่ความทั้งสองฝ่าย ให้ศาลมีคำสั่งให้เอาชำระค่าธรรมเนียมศาลที่ผู้นั้นได้รับยกเว้น จากทรัพย์สินที่ยึดหรืออายัดดังที่กล่าวไว้ในวรรคหนึ่งตามจำนวนที่ศาลเห็นสมควร
(๒) คู่ความอีกฝ่ายหนึ่งจะต้องชำระค่าฤชาธรรมเนียมทั้งหมดหรือแต่บางส่วนแทนผู้ที่ได้รับยกเว้นค่าธรรมเนียมศาล ให้ศาลมีคำสั่งให้คู่ความอีกฝ่ายหนึ่งนั้นชำระค่าธรรมเนียมศาลต่อศาลในนามของผู้ที่ได้รับยกเว้นค่าธรรมเนียมศาล แต่ถ้าคู่ความอีกฝ่ายหนึ่งนั้นไม่ปฏิบัติตามคำสั่ง ให้ศาลเอาชำระค่าธรรมเนียมศาลนั้นจากทรัพย์สินที่ยึดหรืออายัดดังที่กล่าวไว้ในวรรคหนึ่งตามจำนวนที่ศาลเห็นสมควร หรือ
(๓) ผู้ที่ได้รับยกเว้นค่าธรรมเนียมศาลจะต้องชำระค่าฤชาธรรมเนียมทั้งหมดหรือแต่บางส่วนแทนคู่ความอีกฝ่ายหนึ่ง ให้ศาลมีคำสั่งให้เอาชำระค่าฤชาธรรมเนียมนั้นจากทรัพย์สินที่ยึดหรืออายัดดังที่กล่าวไว้ในวรรคหนึ่ง ส่วนค่าธรรมเนียมศาลที่ผู้นั้นได้รับยกเว้น ให้เอาชำระจากทรัพย์สินที่เหลือ ถ้าหากมี ตามจำนวนที่ศาลเห็นสมควร

English translation

If it appears to the court that the person granted exemption from court fees is able to pay court fees, whether from the time of filing the application under Section 156 or at a later time before the court decides the case, the court may order that person to pay the waived court fees to the court within the time the court thinks fit to fix. If that person fails to comply, the court shall order the seizure or attachment of the whole or part of that person's property to await the decision on court fees and costs.
In the case under paragraph one, if the court is of the opinion that:
(1) the court fees and costs are to lie where they fell as between both parties, the court shall order the court fees from which that person was exempted to be paid out of the property seized or attached as stated in paragraph one, in the amount the court thinks fit;
(2) the other party is to pay the whole or part of the court fees and costs in place of the person granted exemption from court fees, the court shall order that other party to pay the court fees to the court in the name of the person granted exemption; but if that other party fails to comply with the order, the court shall have the court fees paid out of the property seized or attached as stated in paragraph one, in the amount the court thinks fit; or
(3) the person granted exemption from court fees is to pay the whole or part of the court fees and costs in place of the other party, the court shall order those court fees and costs to be paid out of the property seized or attached as stated in paragraph one; as for the court fees from which that person was exempted, they shall be paid out of the remaining property, if any, in the amount the court thinks fit.

Section 159 is a claw-back and enforcement mechanism for a fee waiver that should not have stood or should no longer stand. Paragraph one lets the court, on finding that the exempted party can in fact pay, order payment within a fixed time and, failing compliance, seize or attach that party's property to await the final decision on costs. The numbered rules then direct how the waived fees are satisfied from the seized property according to the ultimate cost outcome: where costs lie where they fell (1), where the opponent bears them (2), or where the exempted party is itself liable to the opponent (3). The provision links the waiver regime in Sections 155 to 158 with actual recovery, ensuring the State is not out of pocket where means existed. It is distinct from Section 160, which allows withdrawal of a waiver for misconduct.

Why this matters in practice

A fee waiver is not a permanent free pass. If the court later finds you can pay, for example because assets come to light, it can order you to pay the waived fees and, if you do not, seize or attach your property to secure them, so keep the court informed and comply with any payment order. When you apply for a waiver, be candid about your means: an application that understates what you own can unravel and expose your property to seizure later in the case.

    Where a party granted a fee waiver in fact owns property sufficient to pay, the court orders that party to pay the waived fees, and if unpaid, has them satisfied out of that property under Section 159.

    The defendants held eleven title deeds and so were able to pay the fees even at the time they sought to petition to the Supreme Court as paupers. The court ordered them to pay the waived Dika court fees in full, and directed that, if they did not pay, the fees be satisfied out of the eleven mortgaged title deeds under Section 159.

Une dispense de frais de justice peut-elle être annulée si je suis finalement en mesure de payer ?

Oui. L'article 159 permet au tribunal, s'il constate que la partie exemptée est en mesure de payer, d'ordonner le paiement des frais annulés dans un délai déterminé et, s'ils ne sont pas payés, de saisir ou de bloquer les biens de cette partie en attendant la décision relative aux dépens.

Comment les frais annulés sont-ils recouvrés sur les biens saisis ?

L'article 159 prévoit le recouvrement en fonction de qui supporte les coûts au final : à partir des biens saisis lorsque les coûts sont à leur place, à partir de l'adversaire lorsque celui-ci est responsable, ou à partir des biens saisis et de tout bien restant lorsque la partie exemptée est responsable envers l'adversaire.
