In the case of performance of an obligation as provided in Section 137, if the plaintiff accepts that performance as full satisfaction of the amount claimed, the defendant shall be liable for the court costs, unless the court sees fit to order otherwise. If the plaintiff is not satisfied with such performance and continues the case, the court costs shall be within the court's discretion; but if the court is of the view that the performance was full satisfaction of the plaintiff's claim, the plaintiff shall be liable for all court costs arising from the plaintiff's refusal to accept the performance.

Section 165 is the counterpart of Section 164 for performance of an obligation under Section 137, where the defendant tenders performance rather than a cash deposit. It sorts cost liability by the plaintiff's reaction: acceptance as full satisfaction puts costs on the defendant, subject to the court's power to order otherwise, while continued litigation leaves costs to the court's discretion. Where the court concludes the tendered performance already satisfied the claim in full, the plaintiff bears all costs generated by refusing it. Together with Sections 163 and 164, it discourages a party from prolonging a case over relief already offered.
