A person who causes court costs of execution to be incurred in any part unnecessarily, or with the character of delaying the execution, or that had to be carried on because of that person's fault or gross negligence, or because of executing in bad faith, may be made liable: before the execution is completed, the injured person or the judgment debtor, as the case may be, may file a motion with the court within seven days from the day of becoming aware of the circumstances constituting the ground of the claim, for the court to order such person to be liable for those court costs. An order of the court under this section may be appealed to the Court of Appeal, and the judgment or order of the Court of Appeal shall be final.

Section 169/3 is the execution-stage counterpart of Section 166, and it is the provision to which Section 169/2 is made subject. It lets the court shift execution costs onto the person who wrongly caused them, whether by unnecessary steps, delay, fault or gross negligence, or enforcement in bad faith, rather than leaving them on the default bearer under Section 169/2. The remedy is time-limited and procedural: the injured person or the judgment debtor must move within seven days of learning of the circumstances, and only before execution is completed. A single appeal lies to the Court of Appeal, whose decision is final, giving the matter a quick and definitive route.

    Section 169/3 shifts execution costs only where they arise from the person's fault; where a seized building was demolished under the Building Control Act and that was not the judgment debtor's fault, the claimant who took over the enforcement rights must pay the fee for a seizure with no sale, not the debtor.

    The claimant, having taken an assignment of the creditor's rights, was treated as knowing the condition of the seized building. When the building was later demolished under the Building Control Act, the court held this was not the judgment debtor's fault within Section 169/3, so the claimant, not the debtor, had to pay the fee for the seizure with no sale.
