เพื่อประโยชน์ในการไกล่เกลี่ย เมื่อศาลเห็นสมควรหรือเมื่อคู่ความฝ่ายใดฝ่ายหนึ่งร้องขอ ศาลจะสั่งให้ดำเนินการเป็นการลับเฉพาะต่อหน้าตัวความทุกฝ่ายหรือฝ่ายใดฝ่ายหนึ่ง โดยจะให้มีทนายความอยู่ด้วยหรือไม่ก็ได้

English translation
For the purpose of conciliation, when the court thinks fit or when either party so requests, the court may order the proceedings to be conducted in private, in the presence of all the parties themselves or of any one party, with or without their advocates being present.
When the court thinks fit or when either party so requests, the court may appoint a person or a body of persons to be a conciliator, to assist the court in conciliating the parties so that they reach a compromise.
The rules and methods for the court's conciliation, the appointment of a conciliator, and the powers and duties of the conciliator, shall be as prescribed in the regulations of the President of the Supreme Court issued with the approval of the plenary session of the Supreme Court. The regulations of the President of the Supreme Court under paragraph three, once published in the Government Gazette, shall come into force.

Section 20 bis develops the conciliation power in Section 20 with two practical tools. First, it authorizes confidential conciliation sessions conducted directly with the parties, with the presence of advocates left to the court's discretion or the parties' request, which encourages frank discussion. Second, it lets the court appoint a conciliator, whether an individual or a panel, to assist in bringing the parties to a compromise. The operational detail, covering procedure, appointment and the conciliator's powers and duties, is delegated to regulations of the President of the Supreme Court, approved by the plenary session and effective on publication in the Government Gazette. This section, with Section 20 ter, reflects a deliberate expansion of court-annexed mediation in Thai civil procedure.
