เมื่อศาลมีคำสั่งอนุญาตให้ดำเนินคดีแบบกลุ่มและพ้นระยะเวลาตามมาตรา ๒๒๒/๑๕
(๖) แล้ว ก่อนที่ศาลจะอนุญาตให้มีการตกลงกันหรือประนีประนอมยอมความกันในประเด็นแห่งคดี ให้ศาลกำหนดวันตามที่เห็นสมควรแต่ต้องไม่น้อยกว่าสี่สิบห้าวันเพื่อให้สมาชิกกลุ่มคัดค้านหรือแจ้งความประสงค์ออกจากการเป็นสมาชิกกลุ่มโดยทำเป็นหนังสือยื่นต่อศาล และสั่งให้โจทก์นำเงินค่าใช้จ่ายมาวางศาล เพื่อแจ้งเรื่องการตกลงกันหรือประนีประนอมยอมความกันในประเด็นแห่งคดีให้สมาชิกกลุ่มทราบตามวิธีการเช่นเดียวกับที่กำหนดไว้ในมาตรา ๒๒๒/๑๕ วรรคหนึ่ง เมื่อศาลมีคำสั่งอนุญาตให้มีการตกลงกันหรือประนีประนอมยอมความกันในประเด็นแห่งคดีแล้ว ให้ถือว่าสมาชิกกลุ่มรายที่แจ้งความประสงค์ออกจากการเป็นสมาชิกกลุ่มและมิได้ขอถอนความประสงค์ดังกล่าวก่อนศาลมีคำสั่งอนุญาต ไม่เป็นสมาชิกกลุ่มนับแต่วันที่ศาลมีคำสั่งอนุญาต

English translation
When the court has issued an order permitting the class action and the period under section 222/15(6) has elapsed, before the court permits an agreement or a compromise settlement on the issues of the case, the court shall fix a date, as it deems appropriate but not less than forty-five days, for group members to object or to give notice of their intention to withdraw from group membership in writing filed with the court, and shall order the plaintiff to deposit the expenses with the court in order to notify group members of the agreement or compromise settlement on the issues of the case by the same method prescribed in section 222/15 paragraph one. When the court has permitted the agreement or compromise settlement on the issues of the case, a group member who gave notice of the intention to withdraw from group membership and did not withdraw such notice before the court's order of permission shall be deemed not to be a group member from the date of the court's order of permission.
Where the plaintiff neglects to deposit the expenses with the court under paragraph one without informing the court of the cause of such neglect, the court shall order that the agreement or compromise settlement on the issues of the case not be permitted.

This is the core settlement-review provision of the class action regime and reflects the concern that a representative plaintiff might settle cheaply at the expense of absent members. Court approval is mandatory and is preceded by a member notice-and-objection window of at least forty-five days, mirroring the withdrawal safeguard in section 222/28 and funded the same way. Uniquely, it also gives members an opt-out right at the settlement stage: those who opt out and do not retract cease to be group members and are freed from the settlement's binding effect. The court measures fairness of the settlement using the factors in section 222/32, and the same mechanism is extended to arbitration by section 222/30. The plaintiff's failure to fund notice is again a hard bar to approval.
Why this matters in practice
If you are a group member unhappy with a proposed settlement, this is your moment: you can either object and ask the court to reject it, or opt out to preserve your own claim, but you must act within the court's window and in writing. Opting out means the settlement will not bind you, but it also means you must pursue your claim yourself, so weigh the trade-off carefully. Defendants negotiating a class settlement should expect court scrutiny for fairness, not automatic approval. Because opting out affects your prescription period and your right to sue individually, get advice before deciding.
