Annotation de l'entreprise
This is a procedural provision on how a Court of Appeal judgment is delivered. It gives the court a choice of venue for the reading, either the Court of Appeal itself or the court of first instance, and requires the reading court to fix and notify an appointment date to all appealing parties. The date of reading matters beyond formality, because the one-month period for seeking leave to dika under Section 247 runs from the day the Court of Appeal judgment is read.
Pourquoi cela est important en pratique
Watch the reading date closely: your deadline to seek leave to dika starts on the day the Court of Appeal judgment is read, not the day you actually hear about it, so make sure the court has current contact details for you or your lawyer. If you are abroad, arrange for your Thai lawyer to attend the reading and report the result at once. Our guide on comparaître devant un tribunal en Thaïlande explains how judgment readings work.
