Article 258: When interim orders take effect

คำสั่งศาลซึ่งอนุญาตตามคำขอที่ได้ยื่นตามมาตรา ๒๕๔
(๑) นั้น ให้บังคับจำเลยได้ทันทีแล้วแจ้งคำสั่งนั้นให้จำเลยทราบโดยไม่ชักช้าแต่จะใช้บังคับบุคคลภายนอก ซึ่งพิสูจน์ได้ว่าได้รับโอนโดยสุจริตและเสียค่าตอบแทนก่อนการแจ้งคำสั่งให้จำเลยทราบมิได้คำสั่งศาลซึ่งอนุญาตตามคำขอที่ได้ยื่นตามมาตรา ๒๕๔
(๒) นั้น ให้บังคับจำเลยได้ทันที ถึงแม้ว่าจำเลยจะยังมิได้รับแจ้งคำสั่งเช่นว่านั้นก็ตาม เว้นแต่ศาลจะได้พิเคราะห์พฤติการณ์แห่งคดีแล้วเห็นสมควรให้คำสั่งมีผลบังคับเมื่อจำเลยได้รับแจ้งคำสั่งเช่นว่านั้นแล้วคำสั่งศาลซึ่งอนุญาตตามคำขอที่ได้ยื่นตามมาตรา ๒๕๔
(๓) ที่เกี่ยวกับทรัพย์สินที่พิพาทหรือทรัพย์สินของจำเลยนั้น ให้มีผลใช้บังคับได้ทันที ถึงแม้ว่านายทะเบียน พนักงานเจ้าหน้าที่ หรือบุคคลอื่น ผู้มีอำนาจหน้าที่ตามกฎหมายจะยังมิได้รับแจ้งคำสั่งเช่นว่านั้นก็ตาม เว้นแต่ศาลจะได้พิเคราะห์พฤติการณ์แห่งคดีแล้วเห็นสมควรให้คำสั่งมีผลบังคับเมื่อบุคคลดังกล่าวได้รับแจ้งคำสั่งเช่นว่านั้นแล้วคำสั่งศาลซึ่งอนุญาตตามคำขอที่ได้ยื่นตามมาตรา ๒๕๔
(๓) ที่เกี่ยวกับการกระทำที่ถูกฟ้องร้องให้มีผลใช้บังคับแก่นายทะเบียน พนักงานเจ้าหน้าที่ หรือบุคคลอื่นผู้มีอำนาจหน้าที่ตามกฎหมายต่อเมื่อบุคคลดังกล่าวได้รับแจ้งคำสั่งเช่นว่านั้นแล้วหมายจับจำเลยที่ศาลได้ออกตามคำขอที่ได้ยื่นตามมาตรา ๒๕๔

English translation
An order of the court granting an application filed under Section 254(1) is enforceable against the defendant immediately, and the order shall be notified to the defendant without delay; but it may not be enforced against a third person who proves that he acquired in good faith and for value before the order was notified to the defendant. An order of the court granting an application filed under Section 254(2) is enforceable against the defendant immediately, even though the defendant has not yet been notified of such order, unless the court, having considered the circumstances of the case, thinks fit that the order shall take effect only when the defendant has been notified of it. An order of the court granting an application filed under Section 254(3) relating to the disputed property or the defendant's property is enforceable immediately, even though the registrar, competent official, or other person having authority under the law has not yet been notified of such order, unless the court, having considered the circumstances of the case, thinks fit that the order shall take effect only when such person has been notified of it. An order of the court granting an application filed under Section 254(3) relating to the act complained of is enforceable against the registrar, competent official, or other person having authority under the law only when such person has been notified of it. A warrant of arrest of the defendant issued by the court on an application filed under Section 254(4) is enforceable throughout the Kingdom. Detention under such a warrant of arrest shall not exceed six months from the date of arrest.

Section 258 governs the timing and reach of provisional orders granted under Section 254, distinguishing each of the four measure types. Immediate enforceability against the defendant is the default, but the section carves out protection for a bona fide purchaser for value who acquired before the defendant was notified, and it makes orders directed at registrars effective only on notice to them for matters concerning the act complained of. It works closely with Section 258/2, which addresses when dealings that breach these orders cannot be asserted against the plaintiff. The final paragraph fixes the nationwide reach of an arrest warrant and caps detention at six months from arrest.
Why this matters in practice
The effective date of an order restraining a transfer is critical, and it is not the date the registrar hears about it: an order under Section 254(3) concerning the disputed property or the defendant's property takes effect as soon as the court makes it. Under Section 258/2 a registration accepted after that moment cannot be set up against the plaintiff, and the date the registrar was notified governs one thing only, the cut off for a transferee who proves he acquired in good faith and for value. Creditors should still get the order to the registrar quickly, because an office that has not been told may register a transfer in the meantime, but a gap before notice is not a lost claim. A defendant facing an arrest measure should note the strict six month ceiling on detention.

Under the third paragraph of Section 258, an order restraining transfer of land relating to a Section 254(3) measure takes effect on the date the land official is notified. A transfer made by the defendant after that date cannot be asserted against the plaintiff under Section 258/2, paragraph two, unless the transferee acquired in good faith and for value before that date.
The land official was notified of the protective order on 1 October 2545. The Supreme Court held the order took effect that day under the third paragraph of Section 258, so the defendant's sale of the land to a second defendant on 18 October 2545 could not be asserted against the plaintiff under Section 258/2, paragraph two, since the transfer came after the order took effect.
