Article 26 — Recording objections to court orders

If the court has put a question, or made an order or ruling relating to the conduct of a case, and a party to that case objects to the question, order, or ruling as being unlawful, then, before the court proceeds further with the case, the court shall record in the report the question, order, or ruling objected to and the nature of the objection. As for the grounds relied upon by the objecting party, the court shall, in its discretion, either record them in the report or require the objecting party to submit a written statement to be included in the case file.

Section 26 governs how a party preserves an objection to a court's procedural question, order, or ruling during the case. It requires the court to note the objected matter and the nature of the objection in the report before proceeding, and gives the court discretion over how the party's reasons are captured, either in the report or by a separate written statement. This creates the record on which the party may later rely, and it works closely with Section 226, which conditions the right to appeal certain interlocutory orders on a proper objection having been made at the time.

This Section is easy to overlook but decisive on appeal. If you disagree with an interlocutory order, you generally must object on the record at the time; merely noting your disagreement inside a motion is often not enough, and can cost you the right to appeal that order later. Make sure your objection and its grounds actually go into the court report or a filed written statement. When a hearing turns on such an order, having a clear record and interpretation in the courtroom matters.

    Merely noting an objection inside a motion does not amount to objecting to the court's order under Sections 26 and 226; without a proper objection, the party has no right to appeal or further appeal that order.

    Because defence counsel only recorded an objection inside a motion, the Court held this did not amount to objecting to the trial court's order under Sections 26 and 226. The party was therefore treated as not wishing to challenge the order allowing amendment of the plaint and had no right to appeal or further appeal it, so the Court declined to consider that part.
