Article 326: Sharing pro rata in execution proceeds

เมื่อมีการยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องอย่างใดของลูกหนี้ตามคำพิพากษาเพื่อเอาชำระหนี้แก่เจ้าหนี้ตามคำพิพากษารายหนึ่งแล้ว ห้ามไม่ให้เจ้าหนี้ตามคำพิพากษาอื่นดำเนินการให้มีการยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องนั้นซ้ำอีก แต่ให้มีสิทธิยื่นคำร้องต่อศาลที่ออกหมายบังคับคดี ขอให้มีคำสั่งให้ตนเข้าเฉลี่ยในทรัพย์สินหรือเงินที่ได้จากการขายหรือจำหน่ายทรัพย์สินจากการยึดหรืออายัดนั้นได้ตามส่วนแห่งจำนวนหนี้ตามคำพิพากษา
ห้ามมิให้ศาลอนุญาตตามคำร้องเช่นว่านี้ เว้นแต่ศาลเห็นว่าผู้ยื่นคำร้องไม่สามารถเอาชำระได้จากทรัพย์สินอื่น ๆ ของลูกหนี้ตามคำพิพากษา
ถ้าเจ้าพนักงานผู้มีอำนาจตามกฎหมายว่าด้วยภาษีอากรหรือกฎหมายอื่นที่จะสั่งยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องของลูกหนี้ตามคำพิพากษา เพื่อบังคับชำระหนี้ที่ค้างชำระตามกฎหมายนั้น ๆ ได้เอง ได้ยึดทรัพย์สินหรืออายัดสิทธิเรียกร้องตามวรรคหนึ่งไว้ก่อนแล้ว ให้มีสิทธิขอเข้าเฉลี่ยได้โดยไม่อยู่ภายในบังคับของบทบัญญัติวรรคสอง แต่ถ้าเจ้าพนักงานดังกล่าวมิได้ยึดหรืออายัดไว้ก่อน ให้มีสิทธิขอเข้าเฉลี่ยได้เช่นเดียวกับเจ้าหนี้ตามคำพิพากษาอื่น
ในกรณีที่ยึดทรัพย์สินเพื่อขายทอดตลาดหรือจำหน่ายโดยวิธีอื่น คำร้องเช่นว่านี้ให้ยื่นก่อนสิ้นระยะเวลาสิบห้าวันนับแต่วันที่มีการขายทอดตลาดหรือจำหน่ายทรัพย์สินที่ขายทอดตลาดหรือจำหน่ายได้ในครั้งนั้น ๆ
ในกรณีที่อายัดสิทธิเรียกร้อง ให้ยื่นคำร้องเสียก่อนสิ้นระยะเวลาสิบห้าวันนับแต่วันชำระเงินหรือวันที่มีการขายทอดตลาดหรือจำหน่ายโดยวิธีอื่นซึ่งสิทธิเรียกร้องตามที่อายัดนั้นได้
ในกรณีที่ยึดเงิน ให้ยื่นคำร้องเช่นว่านี้ก่อนสิ้นระยะเวลาสิบห้าวันนับแต่วันยึด

English translation

When property has been seized or a claim of the judgment debtor has been attached in order to satisfy the debt owed to one judgment creditor, no other judgment creditor is permitted to have that property seized or that claim attached again; but such other creditor has the right to file an application with the court that issued the writ of execution, seeking an order that he share in the property or in the money obtained from the sale or disposal of the property from that seizure or attachment, in proportion to the amount of the judgment debt.
The court shall not grant such an application unless it is of the opinion that the applicant cannot obtain satisfaction from other property of the judgment debtor.
If an official having authority under the law on taxation or other law to order, of his own accord, the seizure of property or the attachment of a claim of the judgment debtor in order to enforce payment of arrears under such law, has already seized the property or attached the claim under paragraph one beforehand, that official has the right to apply to share without being subject to the provision of paragraph two; but if such official did not seize or attach beforehand, he has the right to apply to share in the same manner as other judgment creditors.
In the case of the seizure of property to be auctioned or disposed of by other means, such an application shall be filed before the lapse of fifteen days from the date of the auction or disposal of the property that was auctioned or disposed of on each such occasion.
In the case of the attachment of a claim, the application shall be filed before the lapse of fifteen days from the date of payment or the date of the auction or disposal by other means of the claim so attached.
In the case of the seizure of money, such an application shall be filed before the lapse of fifteen days from the date of the seizure.
When a copy of such application has been served on the execution officer, the execution officer shall stay the payment of the money or property under the enforcement, from the sale, disposal, or payment of what was attached on the occasion in respect of which the sharing is sought, as the case may be, until the court has given its ruling. When the court has made any order and it has been sent to the execution officer, the execution officer shall proceed in accordance with such order.

Section 326 opens Part 7 and sets the rule against double seizure: property or a claim already under execution for one creditor cannot be seized or attached again by another, who instead applies to share the proceeds in proportion to their judgment debts. Sharing is not automatic; under paragraph two the court grants it only where the applicant cannot be satisfied from the debtor's other property. Tax and similar officials with their own seizure powers may share, and are freed from the paragraph two condition only if they seized or attached first. The deadlines are keyed to the type of asset, fifteen days from each auction or disposal, from payment or disposal of an attached claim, or from the seizure of money, and once served the officer stays payment until the court rules. The provision was renumbered by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017).

Why this matters in practice

If another creditor got to the debtor's asset first, you do not seize it again, you file to share the money it produces, but only if the debtor has nothing else you can reach. The fifteen-day deadlines are short and asset-specific, and missing them means missing the distribution entirely. Multiple creditors chasing the same debtor is common, so knowing when and how to file a sharing application, and whether it is even worth it, is a core reason to work with a debt collection lawyer.

    Under Section 326 paragraph five, a creditor seeking to share in an attached claim must file the application within fifteen days from the date of payment, and this period fixes the time within which other creditors may apply to share.

    Applying Section 110 paragraph two of the bankruptcy law, the court measured when execution becomes fully complete by reference to the time allowed for other creditors to apply to share under Section 326 paragraph five, which for an attached claim is fifteen days from the date of payment. The execution officer received the check on 21 May 2020, fixing the start of that period.

  2. Arrêt de la Cour suprême n° 835/2566 (2023)

    Section 326 paragraph five fixes the period within which another creditor may apply to share in an attached claim, running from the date the executing officer receives payment. It does nothing more than fix that deadline. The Bankruptcy Act B.E. 2483 gives no definition of execution being fully complete for the purposes of section 90/12(5), which excuses the court from staying execution where it was fully complete before the executing officer learned that a business rehabilitation petition had been filed. That meaning is taken by analogy from section 110 paragraph two of the Bankruptcy Act, which defines execution as fully complete when the period allowed to other creditors to apply to share under the Civil Procedure Code has expired. It is that provision, using the section 326 paragraph five period as its measure, which produces the legal effect.

    The question was when execution is fully complete for the purposes of the exception in section 90/12(5) of the Bankruptcy Act B.E. 2483, which relieves the court of the duty to stay execution. The Supreme Court held that because the rehabilitation provisions give no special definition of that expression, it must be read by analogy with the position where the debtor becomes bankrupt, and section 110 paragraph two of the Act defines execution as fully complete once the period allowed to other creditors to apply to share under the Civil Procedure Code has expired. Section 326 paragraph five supplies that period, running from the executing officer's receipt of payment on 21 May 2020. The legal effect comes from section 110 paragraph two; section 326 paragraph five furnishes the deadline it uses.

Deux créanciers peuvent-ils saisir le même bien ?

Non. En vertu de l'article 326, une fois qu'un créancier a saisi un bien ou a fait une saisie conservatoire, un autre créancier ne peut pas le saisir ou le faire une nouvelle fois, mais peut demander à partager le produit au prorata de ses dettes judiciaires.
