traduction anglaise

For the execution of a case where the court has given a judgment or order granting or declaring that the judgment creditor or any person has acquired ownership, a real right, or other rights concerning property, if that property is registered property and there is an obstacle that prevents the register from being amended or altered, the judgment creditor or such person may apply for the court to order the registrar, the competent official, or the person having authority and duty under the law to carry out the registration so that the person entitled has their name entered in the register in accordance with the order of the court.
The provisions of Section 357 paragraph three shall apply mutatis mutandis.

Annotation de l'entreprise

Section 360 forms Chapter 6 on execution where a judgment confers or confirms rights over registered property. It addresses the common situation where the losing party or an official will not cooperate in updating a register, so the court steps in and directs the registrar, competent official, or authority to enter the winning party's name in line with the judgment. This provision, part of the enforcement machinery renumbered by the Amendment Act (No. 30) B.E. 2560 (2017), applies to any register of title or rights, land, condominium units, mortgages, vehicles, or intellectual property, and it borrows Section 357 paragraph three on procedure by cross-reference.

Pourquoi cela est important en pratique

This section is a practical lifeline when you win a case declaring your title but the Land Office or another registry refuses to transfer, often because the defendant will not sign or hand over documents. Rather than starting a new lawsuit, you go back to the trial court and ask it to direct the registrar to register your name per the judgment. Bring the certified judgment and the exact register details. Because registered-property disputes turn on the precise wording of the judgment and the register, it is worth confirming your position with a avocat thaïlandais before filing, especially where the underlying right sits in the substantive Civil and Commercial Code.

Foire aux questions

The court ruled the land is mine but the Land Office will not transfer it. What can I do?

What kinds of property does Section 360 cover?

Any registered property where a court has confirmed your ownership or other right, including titled land, condominium units, mortgages, registered vehicles, and intellectual property, provided there is an obstacle preventing the register from being changed.
