Article 72: Serving motions and statements

คำร้องและคำแถลงการณ์ซึ่งได้ยื่นต่อศาลภายในเวลาที่กฎหมายหรือศาลกำหนดไว้ หรือโดยข้อตกลงของคู่ความตามที่ศาลจดลงไว้ในรายงานนั้น ให้ผู้ยื่นคำร้องหรือคำแถลงการณ์นำต้นฉบับยื่นไว้ต่อศาลพร้อมด้วยสำเนาเพื่อให้คู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ หรือบุคคลที่เกี่ยวข้องมารับไปโดยทางเจ้าพนักงานศาลบรรดาคำร้องอื่น ๆ ให้ยื่นต่อศาลพร้อมด้วยสำเนา เพื่อส่งให้แก่คู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ หรือบุคคลที่เกี่ยวข้อง และถ้าศาลกำหนดให้เจ้าพนักงานศาลเป็นผู้ส่งสำเนาเช่นว่านั้น ก็ให้เจ้าพนักงานศาลเป็นผู้ส่งโดยให้คู่ความฝ่ายที่ยื่นคำร้องเป็นผู้ออกค่าใช้จ่ายบรรดาเอกสารอื่นๆ เช่น สำเนาคำแถลงการณ์หรือสำเนาพยานเอกสารนั้น ให้ส่งแก่คู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ หรือบุคคลที่เกี่ยวข้อง โดยวิธีใดวิธีหนึ่งในสองวิธีดังต่อไปนี้
(๑) โดยคู่ความฝ่ายที่ต้องส่งนั้น ส่งสำเนาให้แก่คู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ หรือบุคคลที่เกี่ยวข้องเอง แล้วส่งใบรับต่อศาลพร้อมกับต้นฉบับนั้น ๆ ใบรับนั้นจะทำโดยวิธีลงไว้ในต้นฉบับว่าได้รับสำเนาแล้ว และลงลายมือชื่อผู้รับกับวัน เดือน ปีที่ได้รับก็ได้ หรือ
(๒) โดยคู่ความฝ่ายที่ต้องส่งนั้นนำสำเนายื่นไว้ต่อศาลพร้อมกับต้นฉบับ แล้วขอให้เจ้าพนักงานศาลเป็นผู้นำส่งให้แก่คู่ความอีกฝ่ายหนึ่งหรือคู่ความอื่น ๆ หรือบุคคลที่เกี่ยวข้อง ในกรณีเช่นนี้ ผู้ขอต้องไปกับเจ้าพนักงานศาลและเสียค่าธรรมเนียมในการส่งนั้นด้วย

English translation

Motions and statements filed with the court within the time fixed by law or by the court, or by agreement of the parties as recorded by the court, shall be filed by the person filing the motion or statement by submitting the original to the court together with a copy, for the other party or the other parties or the related persons to collect through a court officer. All other motions shall be filed with the court together with a copy for service on the other party or the other parties or the related persons; and if the court directs that a court officer serve such copy, the court officer shall serve it, with the party filing the motion bearing the cost. All other documents, such as a copy of a statement or a copy of documentary evidence, shall be served on the other party or the other parties or the related persons by one of the following two methods:
(1) the party who must serve delivers the copy to the other party or the other parties or the related persons itself, then submits the receipt to the court together with the original; the receipt may be made by noting on the original that the copy has been received, with the signature of the recipient and the day, month, and year of receipt; or
(2) the party who must serve submits the copy to the court together with the original and asks the court officer to deliver it to the other party or the other parties or the related persons; in this case the applicant must go with the court officer and pay the fee for that service.

Section 72 governs the service of motions, statements, and supporting documents, distinguishing between time sensitive motions and everything else. Motions filed within a fixed time are lodged with a copy for the other side to collect through the court officer. Ordinary documents may be served by either of two methods in items (1) and (2): the serving party delivers the copy itself and files a receipt, or it lodges the copy and has the court officer deliver it, going along and paying the fee. The section sits within Title 4 alongside Sections 70 and 71 and interacts with the abandonment rules, since failing to serve a required copy of a motion can be treated as abandoning it.

Why this matters in practice

Pick the right service method and document it. If you deliver a copy yourself under item (1), keep the signed receipt or the noted original; if you use the court officer under item (2), be ready to go along and pay the fee. The most costly mistake is filing a motion, for example to withdraw a claim, and not serving the copy on the other side, which can be argued as abandonment. When deadlines are tight, confirm the steps with a Thai lawyer.

  1. Arrêt de la Cour suprême n° 3091/2524 (1981)

    Section 174 concerns the abandonment of a claim, not the abandonment of a motion to withdraw a claim; withdrawal is governed by section 175. There is therefore no legal support for treating a plaintiff who has not served a copy of his motion to withdraw before the pre-trial date as having abandoned it.

    The defendant argued that because the plaintiff had not served the copy of his motion to withdraw the claim before the pre-trial date, he should be treated as having abandoned the motion and as not wishing to withdraw. The Supreme Court held that section 174 concerns the abandonment of a claim and not of a motion to withdraw, that withdrawal is governed by section 175, and that the plaintiff had duly moved to withdraw and the trial court had allowed it after hearing the defendant's objection. There was no legal support for the defendant's argument.

  2. Arrêt de la Cour suprême n° 627/2502 (1959)

    A party's failure to serve on the opponent a copy of a statement naming additional witnesses does not by itself make the evidence inadmissible under Section 72, where the filing of an additional witness list is governed by and complies with Section 88.

    The defendant argued that the plaintiff's additional witness statement, served without a copy to the defendant, was not admissible under Section 72. The court held that under Section 88 paragraph two, as amended, a party need only file the additional witness list before the close of evidence of the party who bears the burden of proof first, so the plaintiff's additional witness reference did not offend the law.

Comment puis-je signifier une motion à l'autre partie en Thaïlande ?

Conformément à l'article 72, une requête déposée dans le délai imparti est accompagnée d'une copie que la partie adverse peut retirer auprès d'un huissier de justice. D'autres documents peuvent être signifiés soit en remettant soi-même la copie et en déposant un accusé de réception, soit en la faisant remettre par un huissier de justice, moyennant le paiement des frais.

Que se passe-t-il si je ne signifie pas de copie de ma requête ?

Le défaut de signification d'une copie requise, par exemple d'une requête en désistement, peut être interprété comme un abandon de cette requête. La conservation de la preuve de signification, conformément à l'article 72, vous protège contre cette objection.
