In the case mentioned in the preceding section, if one of the courts has already given judgment in the case and an appeal has been filed against that judgment, either party may submit an application, made by motion, to the Court of Appeal, asking for an order to stay the appellate proceedings in that case until the other court has finished adjudicating the other case; and if that latter case is also appealed, the Court of Appeal shall decide both cases together in a single judgment. If the latter case is not appealed, the provisions of Section 146 shall apply.

Section 9 extends the coordination scheme of Section 8 into the appellate stage. Where two cases raise the same or closely connected issues but one has already been decided and appealed, this section lets the Court of Appeal hold that appeal until the other case is resolved, so the two are not decided inconsistently. If the second case is also appealed, both are joined and decided in a single judgment, which is the cleanest way to secure consistency. If the second case is not appealed, the conflict of judgments is resolved instead through Section 146, which governs which judgment prevails when two are inconsistent. Together, Sections 8 and 9 form the Code's answer to parallel related litigation at trial and on appeal.
