The provisions of Sections 123 to 126 shall apply mutatis mutandis to accusations. An officer with the duty to receive an accusation may decline to record the accusation in the following cases: (1) when the accuser refuses to say who he is; (2) when the accusation is made by an anonymous letter. Where an accusation has been recorded but the accuser refuses to sign it, the officer receiving the accusation may decline to deal with that accusation.

This General Principles provision governs accusations, that is, reports of an offence made by someone who is not the injured person, and imports the complaint rules of Sections 123 to 126 with necessary changes. Like Section 122 for complaints, it gives the receiving officer a discretion to decline where the accuser is anonymous or unsigned, protecting officers from being obliged to act on unattributable reports. It works together with the investigation-power provisions (Sections 121, 125, 130, 131), and the case law confirms that a police officer who uncovers wrongdoing during an inquiry may himself make an accusation under Sections 2(8), 17, 18, 125 and 127.

A police officer who investigates a criminal case and, on learning that a person is a suspect, has power to make an accusation under Sections 2(8), 17, 18, 125 and 127; once appointed to the responsible inquiry team he has full power to investigate and gather evidence.
In an oil-smuggling and money-laundering matter, the Supreme Court held that the police officer had power to make an accusation under Sections 2(8), 17, 18, 125 and 127 after inquiries showed the plaintiff was a suspect, and once appointed to the responsible inquiry team could investigate and gather all available evidence.

What is an accusation under Section 127?
It is a report of an offence made by someone who is not the injured person. The complaint rules in Sections 123 to 126 apply to it with necessary changes.
