traduction anglaise
The parties are prohibited from filing a Dika contesting a judgment or order on a question of fact concerning only a measure for safety, even in a case that is not otherwise barred from a Dika. In counting the length of imprisonment under Sections 218 and 219, the period fixed by the court in a judgment or order concerning a measure for safety shall not be included in the calculation.

Annotation de l'entreprise
Introduced as a bis provision, this section handles safety measures (มาตรการเพื่อความปลอดภัย under the Penal Code, such as restraint of habitual offenders or prohibition on entering a specified area), which are preventive rather than punitive. Paragraph one bars a fact-question Dika aimed solely at a safety measure, even in a case otherwise open to a Dika, reflecting the policy that these preventive orders should not by themselves generate Supreme Court fact review. Paragraph two prevents distortion of the thresholds in Sections 218 and 219 by excluding any safety-measure period from the imprisonment count, so a safety measure cannot push a defendant over or under the appeal thresholds.
Pourquoi cela est important en pratique
If your only grievance is the safety measure and it turns on the facts, this section blocks a Dika, so focus any Supreme Court challenge on questions of law or on the substantive penalty instead. When assessing whether Sections 218 or 219 bar your appeal, count only the punitive imprisonment and disregard any safety-measure period, which can change whether you fall above or below the five-year or two-year lines. Because these calculations decide whether the Supreme Court door is open at all, it is worth confirming the arithmetic with counsel before filing.
Foire aux questions
Can I appeal only the safety measure on the facts?
No. Section 219 bis bars a fact-question Dika challenging only a safety measure, even where the case would otherwise not be barred from a Dika.
Does a safety measure count toward the appeal thresholds?
No. When calculating imprisonment for the Section 218 and 219 thresholds, any period fixed for a safety measure is excluded, so only punitive imprisonment is counted.
