Annotation de l'entreprise

The operative rule in this section is short but important: the whole clemency procedure in Book 7, including the routing through the Minister of Justice and the timing and refiling limits, applies not only to full pardons but equally, by analogy, to petitions to commute or reduce a penalty. The material that follows in the statutory text is the schedule appended to the Code. That schedule enumerates the categories of serious offences under the former Penal Law (Kotmai Laksana Aya) that are cross-referenced in section 79 as offences a private person may arrest for without a warrant. The concluding lines reproduce the 1939 constitutional amendment that renamed Siam as Thailand, which is why the older section numbers and the country name appear in this historical form.

Pourquoi cela est important en pratique

For anyone seeking clemency, the useful point is that you do not have to ask for a full pardon: the same procedure lets you petition just to commute a heavier penalty to a lighter one or to reduce the sentence, which can be a more realistic request. The appended schedule matters mainly for reading section 79 on citizen's arrest, since it defines which serious offences a private person may arrest for without a warrant. Because the schedule uses the old Penal Law numbering, cross-check it against the current Penal Code before relying on any particular section reference.

Foire aux questions

Can I ask only to reduce a sentence instead of a full pardon?

Yes. Section 267 applies the same Book 7 procedure to petitions to commute a heavier penalty to a lighter one or to reduce a penalty, not just to full pardons.

What is the schedule appended to the Criminal Procedure Code?

It is a list, referenced in section 79, of the serious offences under the old Penal Law that a private person may arrest for without a warrant, such as rebellion, rape, robbery and offences against life.
