Article 60 — Required contents of a warrant

An arrest warrant, search warrant, detention warrant, imprisonment warrant, or release warrant must be made in writing and contain the following particulars: (1) the place where the warrant is issued; (2) the date on which the warrant is issued; (3) the grounds for issuing the warrant; (4)(a) in the case of an arrest warrant, the name or description of the person to be arrested; (b) in the case of a detention, imprisonment, or release warrant, the name of the person to be detained, imprisoned, or released; (c) in the case of a search warrant, the place to be searched, the name or description of the person or the characteristics of the thing to be searched for, the date and time on which the search is to be carried out, and the name and position of the officer who is to conduct the search; (5)(a) in the case of an arrest, detention, or search warrant, the offence or the measure for safety; (b) in the case of an imprisonment warrant, the offence and the penalty according to the judgment; (c) in the case of a detention or imprisonment warrant, the place where the person is to be detained or imprisoned; (d) in the case of a release warrant, the grounds for release; (6) the signature and the seal of the court.

This provision prescribes the mandatory form and content of every type of criminal warrant, standardising what must appear on the face of the document. The itemised requirements, from the grounds for issuance to the identity of the target and, for search warrants, the place, timing, and executing officer, make each warrant self-explaining and auditable. The requirement of the court's signature and seal authenticates the instrument, while the grounds and offence entries connect the warrant back to the substantive basis for the coercive measure. It works with Section 59/1, which requires evidence and reasons before issuance, and Section 62, which governs how the contents are communicated on execution.

What must a Thai arrest or search warrant contain?

Under Section 60, it must be in writing and state the place and date of issue, the grounds, the person or thing targeted, the offence, and the court's signature and seal; search warrants must also state the place, time of search, and executing officer.

Is a warrant valid without the court's signature and seal?

Section 60(6) requires the court's signature and seal as a mandatory particular, so a warrant lacking them does not meet the form the Code prescribes.
