Annotation de l'entreprise

This provision directs where the product of an executed warrant must go: the arrested person or the person or thing found on a search is to be delivered promptly to the issuing court or the official named in the warrant. The phrase if it can be done and the exception unless otherwise ordered give practical latitude where immediate delivery is impossible or where the court has directed a different course. It complements Section 63, which requires the return of the execution record, by ensuring that what the warrant secured is placed under the control of the authorising court or designated officer. The provision reinforces judicial oversight of custody and seized items in the general part on warrants.

Pourquoi cela est important en pratique

If you are arrested under a warrant, this section is why you should be brought before the issuing court or the designated official promptly rather than held indefinitely by the arresting officers. For seized items, it means property taken on a search should be routed to the court or named official, which is relevant if you later seek its return. If you are detained or your property is seized under a warrant, consulter un avocat thaïlandais about the next steps and timing.
