ผู้ใดกระทำการใด ๆ ต่อธงหรือเครื่องหมายอื่นใดอันมีความหมายถึงรัฐ เพื่อเหยียดหยามประเทศชาติ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๕ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]
English translation
Whoever does anything to the flag or to any other emblem signifying the State in order to insult the nation shall be liable to imprisonment not exceeding two years, or a fine not exceeding forty thousand baht, or both.

Firm annotation
The elements are an act directed at the flag or another emblem signifying the State, and the purpose of insulting the nation. The purpose is what carries the section: damaging a flag carelessly, or for an unrelated reason, is outside it. The emblem need not be a flag, which is why the wording extends to any other emblem signifying the State. Section 135 is the mirror provision protecting the flag of a friendly foreign State, at the same penalty.
