ผู้ใดกระทำการใด ๆ ต่อธงหรือเครื่องหมายอื่นใดอันมีความหมายถึงรัฐ เพื่อเหยียดหยามประเทศชาติ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ หมายเหตุ: [อัตราโทษ แก้ไขเพิ่มเติมโดยมาตรา ๕ แห่งพระราชบัญญัติแก้ไขเพิ่มเติมประมวลกฎหมายอาญา (ฉบับที่ ๒๖) พ.ศ. ๒๕๖๐]

มาตรา 118 มิใช่ฐานความผิดโดยลำพัง แต่เป็นบทเพิ่มโทษในหมวดความผิดต่อความมั่นคงของรัฐภายในราชอาณาจักร โดยใช้กับความผิดพื้นฐานตามมาตรา 113 มาตรา 114 และมาตรา 117 เท่านั้น องค์ประกอบสำคัญคือผู้กระทำได้กระทำเพื่อหรือเนื่องจากได้รับความช่วยเหลือจากรัฐต่างประเทศหรือคนต่างด้าว โจทก์ต้องพิสูจน์ความผิดพื้นฐานก่อน แล้วจึงพิสูจน์ความเชื่อมโยงกับความช่วยเหลือจากต่างชาติ จึงจะเพิ่มโทษกึ่งหนึ่งได้ เพดานโทษจึงขึ้นอยู่กับว่าฟ้องมาตราพื้นฐานใด
