ผู้ใดได้รับมอบหมายจากรัฐบาลให้กระทำกิจการของรัฐกับรัฐบาลต่างประเทศ ถ้าและโดยทุจริตไม่ปฏิบัติการตามที่ได้รับมอบหมายต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี

Whoever is entrusted by the Government to conduct State business with a foreign government, and dishonestly fails to carry out that business as entrusted, shall be liable to imprisonment from one to ten years.

Firm annotation
This is an offence of position. It applies only to a person entrusted by the Government to conduct State business with a foreign government, and the failure must be dishonest. Simple incompetence, or a good-faith departure from instructions, falls outside it. The penalty of one to ten years reflects the trust involved rather than any measurable loss, which need not be proved.
