ผู้ใดได้รับมอบหมายจากรัฐบาลให้กระทำกิจการของรัฐกับรัฐบาลต่างประเทศ ถ้าและโดยทุจริตไม่ปฏิบัติการตามที่ได้รับมอบหมายต้องระวางโทษจำคุกตั้งแต่หนึ่งปีถึงสิบปี

มาตรา 126 เป็นบทเพิ่มโทษที่ผูกกับความผิดพื้นฐานตามมาตรา 124 และ 125 องค์ประกอบที่เพิ่มเข้ามาคือการได้มาหรือเปิดเผยความลับนั้นทำเพื่อประโยชน์แก่รัฐต่างประเทศ ความมุ่งหมายเพื่อประโยชน์ต่างชาตินี้เปลี่ยนโทษจากอัตราพื้นฐาน (ไม่เกินสิบปี หรือหนึ่งปีถึงสิบปี) เป็นห้าปีถึงสิบห้าปีที่กำหนดไว้ สะท้อนภัยที่ร้ายแรงกว่าเมื่อข้อมูลด้านความมั่นคงมุ่งไปสู่อำนาจต่างชาติ มิใช่เพียงจัดการโดยมิชอบภายในประเทศ
