ถ้าหุ้นส่วนของผู้ใดได้กำหนดไว้แต่เพียงข้างฝ่ายกำไรว่าจะแบ่งเอาเท่าไร หรือกำหนดแต่เพียงข้างขาดทุนว่าจะยอมขาดเท่าไรฉะนี้ไซร้ ท่านให้สันนิษฐานไว้ก่อนว่าหุ้นส่วนของผู้นั้นมีส่วนกำไรและส่วนขาดทุนเป็นอย่างเดียวกัน
