เมื่อได้จดทะเบียนมูลนิธิแล้ว ถ้าผู้ขอจัดตั้งมูลนิธิมีชีวิตอยู่ ให้ทรัพย์สินที่จัดสรรไว้เพื่อการนั้นตกเป็นของมูลนิธิตั้งแต่วันที่นายทะเบียนรับจดทะเบียนมูลนิธิเป็นต้นไปในกรณีที่ผู้ขอจัดตั้งมูลนิธิถึงแก่ความตายก่อนนายทะเบียนรับจดทะเบียนมูลนิธิ เมื่อได้จดทะเบียนมูลนิธิแล้ว ให้ทรัพย์สินที่จัดสรรไว้เพื่อการนั้นตกเป็นของมูลนิธิตั้งแต่เวลาที่ผู้ขอจัดตั้งมูลนิธินั้นถึงแก่ความตาย

English translation
After registration of the foundation, if the applicant for creating the foundation is still alive, the property appropriated therefore shall vest in the foundation from the date of registration of the foundation by the registrar. If the applicant for creating a foundation dies before the registration of the foundation by the registrar, the property appropriated therefore shall vest in the foundation from the death of the applicant after the registration.
