Le propriétaire d'un terrain est tenu de recevoir les eaux de drainage artificiel provenant du terrain situé en amont, si, avant ce drainage, ces eaux s'écoulaient naturellement sur son terrain. Si ce drainage artificiel cause des dommages, les propriétaires des terrains situés en aval peuvent, sans préjudice de toute demande d'indemnisation, exiger du propriétaire du terrain situé en amont, à ses frais, qu'il achemine les eaux de drainage à travers leurs terrains jusqu'à un cours d'eau ou un égout public.
