Le propriétaire d'un terrain peut couper et conserver les racines d'un arbre ou d'un arbuste qui ont pénétré sur son terrain depuis la parcelle voisine. Il peut également couper et conserver les branches qui empiètent sur son terrain après avoir donné au propriétaire de la parcelle voisine un préavis raisonnable de les enlever, si ce préavis n'a pas été respecté.
