ในกรณีที่ชายผู้เป็นหรือเคยเป็นคู่สมรสได้ฟ้องคดีที่ไม่รับเด็กเป็นบุตรแล้วและตายก่อนคดีนั้นถึงที่สุด ผู้มีสิทธิได้รับมรดกร่วมกับเด็กหรือผู้จะเสียสิทธิรับมรดกเพราะการเกิดของเด็กนั้น จะขอเข้าเป็นคู่ความแทนที่หรืออาจถูกเรียกให้เข้ามาเป็นคู่ความแทนที่ชายผู้เป็นหรือเคยเป็นคู่สมรสก็ได้

Where the man who is or was a spouse has brought an action to repudiate the child and dies before the action becomes final, a person entitled to inherit together with the child, or who would lose a right of inheritance because of the child's birth, may apply to be substituted as a party, or may be summoned to be substituted for the man who is or was a spouse.
