หากปรากฏว่าบุคคลที่ศาลตั้งให้เป็นผู้ปกครองเป็นผู้ต้องห้ามมิให้เป็นผู้ปกครองตามมาตรา ๑๕๘๗ อยู่ในขณะที่ศาลตั้งให้เป็นผู้ปกครองโดยปรากฏแก่ศาลเองหรือผู้มีส่วนได้เสียหรืออัยการร้องขอ ให้ศาลสั่งเพิกถอนคำสั่งตั้งผู้ปกครองนั้นเสียและมีคำสั่งเกี่ยวกับผู้ปกครองต่อไปตามที่เห็นสมควร การเพิกถอนคำสั่งตั้งผู้ปกครองตามวรรคหนึ่ง ไม่กระทบกระเทือนสิทธิของบุคคลภายนอกผู้กระทำการโดยสุจริต เว้นแต่ในกรณีการเพิกถอนคำสั่งตั้งผู้ปกครองที่ต้องห้ามตามมาตรา ๑๕๘๗ (๑) หรือ (๒) การกระทำของผู้ปกครองไม่ผูกพันผู้เยาว์ไม่ว่าบุคคลภายนอกจะได้กระทำการโดยสุจริตหรือไม่

S’il apparaît que la personne désignée comme tuteur par le tribunal est, au moment de sa désignation, une personne interdite de tutelle au sens de l’article 1587, le tribunal, de sa propre initiative ou sur requête d’une personne intéressée ou du procureur, révoque l’ordonnance de désignation et rend toute mesure qu’il juge appropriée concernant le tuteur. La révocation de l’ordonnance de désignation du tuteur visée au paragraphe 1 ne porte pas atteinte aux droits du tiers agissant de bonne foi, sauf si, en cas de révocation de l’ordonnance de désignation, la personne interdite de tutelle au sens des paragraphes 1587(1) ou (2) est visée, les actes accomplis par le tuteur ne sont pas opposables au mineur, que le tiers ait agi de bonne foi ou non.
