บุคคลที่บรรลุนิติภาวะแล้วอาจถูกตั้งเป็นผู้ปกครองได้ เว้นแต่ (๑) ผู้ซึ่งศาลสั่งว่าเป็นคนไร้ความสามารถ หรือเสมือนไร้ความสามารถ (๒) ผู้ซึ่งเป็นบุคคลล้มละลาย (๓) ผู้ซึ่งไม่เหมาะสมที่จะปกครองผู้เยาว์หรือทรัพย์สินของผู้เยาว์ (๔) ผู้ซึ่งมีหรือเคยมีคดีในศาลกับผู้เยาว์ ผู้บุพการีหรือพี่น้องร่วมบิดามารดาหรือร่วมแต่บิดาหรือมารดากับผู้เยาว์ (๕) ผู้ซึ่งบิดาหรือมารดาที่ตายได้ทำหนังสือระบุชื่อห้ามไว้มิให้เป็นผู้ปกครอง

English translation
Any person sui juris may be appointed a guardian, except the following: 1. person adjudged incompetent or quasi incompetent; 2. person who is bankrupt; 3. person who is unfit to take charge of the person or property of the minor; 4. person having or having had a lawsuit against the minor, ascendants or brothers and sisters of full blood or brothers and sisters of half blood of the minor; 5. person having been excluded by name in writing from guardianship by the deceaded parent.
