ผู้ปกครองตามมาตรา ๑๕๘๕ นั้น ให้ตั้งโดยคำสั่งศาลเมื่อมีการร้องขอของญาติของผู้เยาว์ อัยการ หรือผู้ซึ่งบิดาหรือมารดาที่ตายทีหลังได้ระบุชื่อไว้ในพินัยกรรมให้เป็นผู้ปกครอง ภายใต้บังคับมาตรา ๑๕๙๐ การตั้งผู้ปกครองนั้นถ้ามีข้อกำหนดพินัยกรรมก็ให้ศาลตั้งตามข้อกำหนดพินัยกรรม เว้นแต่พินัยกรรมนั้นไม่มีผลบังคับหรือบุคคลที่ระบุชื่อไว้ในพินัยกรรมนั้นเป็นบุคคลที่ต้องห้ามมิให้เป็นผู้ปกครองตามมาตรา ๑๕๘๗

Le tuteur désigné aux termes de l'article 1585 est nommé par ordonnance du tribunal sur requête d'un parent du mineur, du procureur de la République ou de la personne nommée dans le testament du dernier parent survivant. Sous réserve de l'article 1590, le tribunal nomme le tuteur en cas de disposition testamentaire relative à la nomination d'un tuteur, sauf si le testament est nul ou si la personne désignée dans le testament est inéligible à la fonction de tuteur en vertu de l'article 1587.
