บุคคลที่ยังไม่บรรลุนิติภาวะและไม่มีบิดามารดาหรือบิดามารดาถูกถอนอำนาจปกครองเสียแล้วนั้น จะจัดให้มีผู้ปกครองขึ้นในระหว่างที่เป็นผู้เยาว์ก็ได้ ในกรณีที่ผู้ใช้อำนาจปกครองถูกถอนอำนาจปกครองบางส่วนตามมาตรา ๑๕๘๒ วรรคหนึ่ง ศาลจะตั้งผู้ปกครองในส่วนที่ผู้ใช้อำนาจปกครองถูกถอนอำนาจปกครองนั้นก็ได้ หรือในกรณีที่ผู้ใช้อำนาจปกครองถูกถอนอำนาจจัดการทรัพย์สินตามมาตรา ๑๕๘๒ วรรคสอง ศาลจะตั้งผู้ปกครองเพื่อจัดการทรัพย์สินก็ได้

Une personne mineure et sans parents, ou dont les parents sont déchus de leurs droits parentaux, peut se voir attribuer un tuteur. Si la personne exerçant l'autorité parentale a été partiellement déchue de celle-ci en vertu du paragraphe 1 de l'article 1582, le tribunal peut désigner un tuteur pour exercer la partie restante de l'autorité parentale ou, si la déchue des droits de gestion de la personne exerçant l'autorité parentale a été effectuée en vertu du paragraphe 2 de l'article 1582, désigner un tuteur chargé de la gestion des biens.
