S'il existe une obligation du tuteur envers le pupille ou du pupille envers le tuteur, ce dernier doit en informer le tribunal avant de procéder à l'inventaire. Si le tuteur a connaissance d'une obligation à son profit envers le pupille et omet d'en informer le tribunal, cette obligation est éteinte. Si le tuteur a connaissance d'une obligation à son encontre envers le pupille et omet d'en informer le tribunal, celui-ci peut le décharger de ses fonctions.
