การร้องขอให้ถอนผู้ปกครองตามมาตรา ๑๕๙๘/๘ นั้น ผู้อยู่ในปกครองซึ่งมีอายุไม่ต่ำกว่าสิบห้าปีบริบูรณ์ หรือญาติของผู้อยู่ในปกครองหรืออัยการจะเป็นผู้ร้องขอก็ได้
