พินัยกรรมที่บุคคลทำให้แก่เจ้าหนี้คนใดของตนนั้น ให้สันนิษฐานไว้ก่อนว่า มิได้ทำขึ้นเพื่อชำระหนี้อันค้างชำระแก่เจ้าหนี้คนนั้น
