Dans l'année suivant le décès du bénéficiaire, mais après quinze jours à compter de ce décès, tout héritier ou personne intéressée peut notifier à l'administrateur testamentaire s'il accepte ou refuse la charge. Si l'administrateur notifié ne se prononce pas dans le mois suivant la réception de cette notification, son refus est réputé acquis. Toutefois, l'acceptation n'est possible qu'avec l'autorisation du tribunal après un an.
