Where, after the division of the estate, the whole or part of the property allotted to an heir is lost to him by eviction, the other heirs must compensate him.
That liability is extinguished where it has been otherwise agreed, or where the eviction results from the fault of the heir evicted, or from a cause arising after the division.
The other heirs must compensate the heir evicted in proportion to their shares, deducting the proportionate part which the heir evicted must himself bear. Where one of the heirs is insolvent, the others are liable for his part in the same proportion, deducting the proportionate part which the heir entitled to compensation must bear for the insolvent heir.
The preceding paragraphs do not apply to a beneficiary under a particular title.
