ถ้าเงื่อนไขสำเร็จแล้วในเวลาทำนิติกรรม หากเป็นเงื่อนไขบังคับก่อนให้ถือว่านิติกรรมนั้นไม่มีเงื่อนไข หากเป็นเงื่อนไขบังคับหลังให้ถือว่านิติกรรมนั้นเป็นโมฆะ ถ้าเป็นอันแน่นอนในเวลาทำนิติกรรมว่าเงื่อนไขไม่อาจสำเร็จได้ หากเป็นเงื่อนไขบังคับก่อนให้ถือว่านิติกรรมนั้นเป็นโมฆะ หากเป็นเงื่อนไขบังคับหลังให้ถือว่านิติกรรมนั้นไม่มีเงื่อนไข ตราบใดที่คู่กรณียังไม่รู้ว่าเงื่อนไขได้สำเร็จแล้วตามวรรคหนึ่ง หรือไม่อาจสำเร็จได้ตามวรรคสอง ตราบนั้นคู่กรณียังมีสิทธิและหน้าที่ตามมาตรา ๑๘๔ และมาตรา ๑๘๕

Lorsque la condition est déjà remplie au moment de l'acte juridique, celui-ci est valable sans condition si la condition est antérieure, et nul si la condition est postérieure. Lorsqu'il est certain, au moment de l'acte juridique, que la condition ne peut être remplie, l'acte est nul si la condition est antérieure, et valable sans condition si la condition est postérieure. Les parties conservent les droits et obligations prévus aux articles 184 et 185 tant qu'elles ignorent si la condition est remplie au sens du premier alinéa ou ne peut être remplie au sens du second.
