อายุความสิทธิเรียกร้องของผู้เยาว์หรือของคนไร้ความสามารถหรือของคนเสมือนไร้ความสามารถ ที่จะฟ้องร้องผู้แทนโดยชอบธรรมหรือผู้อนุบาลหรือผู้พิทักษ์ของตนนั้น ถ้าจะครบกำหนดลงในขณะที่บุคคลดังกล่าวยังไม่ลุถึงความสามารถเต็มภูมิ หรือในระหว่างหนึ่งปีนับแต่วันที่บุคคลดังกล่าวไม่มีผู้แทนโดยชอบธรรมหรือผู้อนุบาลหรือผู้พิทักษ์ อายุความนั้นยังไม่ครบกำหนดจนกว่าจะครบหนึ่งปีนับแต่วันที่บุคคลนั้นได้ลุถึงความสามารถเต็มภูมิหรือได้มีผู้แทนโดยชอบธรรมหรือผู้อนุบาลหรือผู้พิทักษ์ แล้วแต่กรณี แต่ถ้าอายุความสิทธิเรียกร้องนั้นมีระยะเวลาน้อยกว่าหนึ่งปี ก็ให้นำกำหนดระยะเวลาที่สั้นกว่านั้นมาใช้แทนกำหนดระยะเวลาหนึ่งปีดังกล่าว

Si la prescription de l'action d'un mineur, d'une personne incapable ou quasi incapable à l'encontre de son représentant légal, tuteur ou curateur est acquise avant que cette personne n'ait recouvré sa pleine capacité, ou dans l'année suivant le jour où elle se retrouve sans représentant légal, tuteur ou curateur, si ce délai n'est pas expiré avant l'expiration d'un an après qu'elle a recouvré sa pleine capacité ou qu'elle a un représentant légal, un tuteur ou un curateur, selon le cas, alors ce délai court. Si le délai de prescription de l'action est inférieur à un an, c'est ce délai plus court qui s'applique.
