ลูกหนี้จะต้องรับผิดชอบในความเสียหายบรรดาที่เกิดแต่ความประมาทเลินเล่อในระหว่างเวลาที่ตนผิดนัด ทั้งจะต้องรับผิดชอบในการที่การชำระหนี้กลายเป็นพ้นวิสัยเพราะอุบัติเหตุอันเกิดขึ้นในระหว่างเวลาที่ผิดนัดนั้นด้วย เว้นแต่ความเสียหายนั้น ถึงแม้ว่าตนจะได้ชำระหนี้ทันเวลากำหนดก็คงจะต้องเกิดมีอยู่นั่นเอง

English translation
A debtor is responsible for all damage caused by negligence during the time of his default. He is also responsible where performance becomes impossible by reason of an accident occurring during the time of the default, unless the damage would have arisen even if he had performed in due time.
