Si, du fait d'un événement rendant l'exécution impossible, le débiteur acquiert un bien de substitution ou une créance relative à l'objet de la dette, le créancier peut exiger la restitution du bien de substitution ou réclamer lui-même une indemnisation. Si le créancier dispose d'une créance pour inexécution, l'indemnisation qui lui est due est diminuée, s'il exerce le droit prévu au paragraphe précédent, de la valeur du bien de substitution ou de la créance.
