การรับช่วงสิทธิย่อมมีขึ้นด้วยอำนาจกฎหมายและย่อมสำเร็จเป็นประโยชน์แก่บุคคลดังจะกล่าวต่อไปนี้ คือ(๑) บุคคลซึ่งเป็นเจ้าหนี้อยู่เอง และมาใช้หนี้ให้แก่เจ้าหนี้อีกคนหนึ่งผู้มีสิทธิจะได้รับใช้หนี้ก่อนตน เพราะเขามีบุริมสิทธิ หรือมีสิทธิจำนำจำนอง(๒) บุคคลผู้ได้ไปซึ่งอสังหาริมทรัพย์ใด และเอาเงินราคาค่าซื้อใช้ให้แก่ผู้รับจำนองทรัพย์นั้นเสร็จไป(๓) บุคคลผู้มีความผูกพันร่วมกับผู้อื่น หรือเพื่อผู้อื่นในอันจะต้องใช้หนี้ มีส่วนได้เสียด้วยในการใช้หนี้นั้น และเข้าใช้หนี้นั้น

English translation
Subrogation takes place by operation of law and ensues to the benefit of the following persons: 1. The person who, being himself a creditor, pays another creditor who has priority to him ow ing to such other creditor having a preferential right, pledge or mortgage. 2. When acquires an immovable property, the person who uses the purchase price in paying off the persons who have mortgages thereon. 3. The person who, being bound with other or for others to pay a debt and was interested in paying the same, has paid it.
