En cas d'insolvabilité du débiteur, le créancier dispose d'un droit de rétention, même si sa créance n'est pas encore exigible. Si l'insolvabilité est survenue ou a été portée à la connaissance du créancier après la remise du bien, il peut exercer ce droit de rétention, même si une obligation contractée antérieurement ou une instruction du débiteur s'y oppose.
