คำมั่นจะให้รางวัลอันมีความประสงค์เป็นการประกวดชิงรางวัลนั้น จะสมบูรณ์ก็ต่อเมื่อได้กำหนดระยะเวลาไว้ในคำโฆษณาด้วย การที่จะตัดสินว่าผู้ประกวดคนไหนได้กระทำสำเร็จตามเงื่อนไขในคำมั่นภายในเวลากำหนดหรือไม่ก็ดี หรือตัดสินในระหว่างผู้ประกวดหลายคนนั้นว่าคนไหนดีกว่ากันอย่างไรก็ดี ให้ผู้ชี้ขาดซึ่งได้ระบุชื่อไว้ในโฆษณานั้นเป็นผู้ตัดสิน หรือถ้ามิได้ระบุชื่อผู้ชี้ขาดไว้ ก็ให้ผู้ให้คำมั่นเป็นผู้ตัดสิน คำตัดสินอันนี้ย่อมผูกพันผู้ที่เกี่ยวข้องด้วยทุกฝ่าย ถ้าได้คะแนนทำดีเสมอกัน ท่านให้นำบทบัญญัติแห่งมาตรา ๓๖๔ วรรค ๒ มาใช้บังคับ แล้วแต่กรณี การโอนกรรมสิทธิ์ในทรัพย์ที่ทำขึ้นประกวดนั้น ผู้ให้คำมั่นจะเรียกให้โอนแก่ตนได้ต่อเมื่อได้ระบุไว้ในโฆษณาว่าจะพึงโอนเช่นนั้น

English translation
A promise of reward which has a prize competition is valid only if a period of time is fixed in the advertisement. The decision whether any competitor fulfils the conditions of the promise within the period, or which one among several competitors deserves the preference, shall be made by the umpire named in the advertisement, or in the absence of any such, by the promisor of the reward. The decision is binding upon the parties concerned. In case of equality of merit the provisions of Section 364 paragraph 2 apply correspondingly. The transfer of ownership of the thing produced may be demanded by the promisor only of he has specified in the advertisement that such transfer shall be made.
