Lorsque l'on peut prévoir avec certitude, pendant l'exécution des travaux, que, par la faute de l'entrepreneur, les travaux seront exécutés de manière défectueuse ou contrairement aux termes du contrat, le maître d'ouvrage peut enjoindre l'entrepreneur à remédier au défaut ou à se conformer aux termes du contrat dans un délai raisonnable fixé dans la notification, faute de quoi le maître d'ouvrage est en droit de faire réparer ou poursuivre les travaux par un tiers aux risques et frais de l'entrepreneur.
