ถ้าผู้ว่าจ้างเป็นผู้จัดหาสัมภาระ และการที่จ้างทำนั้นพังทลายหรือบุบสลายลงก่อนได้ส่งมอบกันถูกต้องไซร้ ท่านว่าความวินาศนั้นตกเป็นพับแก่ผู้ว่าจ้าง หากความวินาศนั้นมิได้เป็นเพราะการกระทำของผู้รับจ้างในกรณีเช่นว่านี้ สินจ้างก็เป็นอันไม่ต้องใช้ เว้นแต่ความวินาศนั้นเป็นเพราะการกระทำของผู้ว่าจ้าง

English translation
If the employer supplies the materials and the work is destroyed or damaged before proper delivery, the loss falls on the employer, provided that the destruction is not due to any act of the contractor. In such a case no remuneration is payable, unless the destruction is due to an act of the employer.
