Where the consignee cannot be found, or refuses to take delivery of the goods, the carrier must notify the consignor at once and ask for instructions.
Where circumstances prevent this, or where the consignor fails to send instructions in reasonable time, or sends instructions that cannot be carried out, the carrier may deposit the goods at the deposit office.
Where the goods are perishable and delay would risk damage, or where their value would not appear to cover the freight and its accessories, the carrier may sell them by public auction.
The carrier must notify the consignor or the consignee of any such deposit or sale without delay, unless he is unable to do so; if he neglects to give notice, he is liable in damages.
